We will make intentional trespass a criminal offence, and we will also give councils greater powers within the planning system.

Our verdict

  • This is a pledge to make trespassing on private land a criminal offence, meaning police could remove people from land if their presence was unauthorised.
  • The previous government launched a public consultation on this issue which ran from 5 November 2019 to 4 March 2020. The results are under review.
  • There has been concern expressed about the potential impact of this legislation, including a successful petition, but with the government response to the consultation pending, this policy is ‘in progress’.
